Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs use of the AcknowledgePoint Services. This AUP is incorporated into the Terms of Service.
Customer and users may not use the Services in any way that violates this AUP.
1. LAWFUL USE ONLY
Customer may use the Services only for lawful business purposes and in compliance with all applicable laws, regulations, and contractual obligations.
2. PROHIBITED CONTENT
Customer may not create, store, process, transmit, publish, assign, or distribute content through the Services that:
- is unlawful;
- is fraudulent;
- is deceptive or misleading;
- infringes intellectual property rights;
- violates privacy rights;
- violates publicity rights;
- is defamatory, harassing, abusive, threatening, or malicious;
- promotes discrimination or unlawful harassment;
- includes hate speech;
- contains sexually explicit content unrelated to legitimate workplace policy needs;
- promotes violence or illegal activity;
- contains malware, malicious code, or harmful scripts;
- contains unlawful surveillance instructions;
- contains unauthorized confidential information; or
- violates any applicable employment, labor, safety, or workplace law.
3. PROHIBITED CONDUCT
Customer and users may not:
- access the Services without authorization;
- share accounts or credentials except as permitted;
- bypass access controls;
- interfere with service operation;
- probe, scan, or test vulnerabilities without permission;
- attempt to gain unauthorized access to systems or data;
- reverse engineer the Services;
- scrape or harvest data;
- overload or disrupt the Services;
- use bots or automated tools without permission;
- upload or transmit malware;
- impersonate another person;
- misrepresent authority;
- use the Services for spam or unsolicited communications;
- remove proprietary notices;
- use the Services to build a competing product;
- use the Services to violate third-party rights;
- use the Services to unlawfully monitor employees;
- use the Services for retaliatory or discriminatory employment actions; or
- assist others in violating this AUP.
4. EMPLOYMENT AND WORKPLACE USE
AcknowledgePoint is intended to help customers manage internal documents and acknowledgements. Customer may not use the Services to:
- unlawfully discriminate against employees;
- retaliate against employees for protected activity;
- misrepresent acknowledgement status;
- falsify acknowledgement records;
- backdate records in a misleading manner;
- coerce unlawful waivers;
- conceal legally required notices;
- replace legally required training where training is required;
- imply legal compliance where compliance has not been reviewed; or
- use employee data in ways prohibited by law.
5. SENSITIVE INFORMATION
Customer should not include unnecessary sensitive information in the Services, including:
- Social Security numbers;
- driver’s license numbers;
- passport numbers;
- financial account numbers;
- full payment card numbers;
- medical records;
- genetic data;
- biometric identifiers;
- precise geolocation data;
- protected class information;
- union membership information;
- criminal history; or
- other sensitive personal information.
If Customer determines that sensitive information is necessary, Customer is solely responsible for ensuring lawful processing and appropriate safeguards.
6. SECURITY REQUIREMENTS
Customer must:
- use reasonable password practices;
- protect administrator accounts;
- promptly remove inactive users;
- limit permissions;
- promptly report suspected unauthorized access;
- ensure user email addresses are accurate;
- train administrators;
- maintain endpoint security;
- avoid using shared administrator accounts; and
- cooperate with AcknowledgePoint security investigations.
7. SYSTEM INTEGRITY
Customer may not use the Services in a way that damages, disables, overburdens, or impairs the Services or interferes with other customers.
8. THIRD-PARTY RIGHTS
Customer may not use the Services to store or distribute content that infringes or violates third-party intellectual property, confidentiality, privacy, employment, or contractual rights.
9. REPORTING VIOLATIONS
Suspected violations of this AUP may be reported to:

10. ENFORCEMENT
AcknowledgePoint may investigate suspected violations of this AUP. AcknowledgePoint may:
- remove or disable access to content;
- suspend users;
- restrict features;
- place accounts on hold;
- terminate accounts;
- notify Customer administrators;
- notify law enforcement if appropriate;
- preserve evidence;
- cooperate with legal requests; and
- take other action reasonably necessary to protect the Services, customers, users, or third parties.
11. NO DUTY TO MONITOR
AcknowledgePoint does not assume a general duty to monitor Customer content. However, AcknowledgePoint may review content or activity if necessary for support, security, legal compliance, abuse prevention, or enforcement.
12. CHANGES TO THIS AUP
AcknowledgePoint may update this AUP from time to time. Continued use of the Services after an updated AUP becomes effective constitutes acceptance of the updated AUP.
